Under Australian Consumer Law, consumers are entitled to a repair, replacement, or refund if goods fail to meet consumer guarantees, with the remedy depending on whether the problem is major or minor.

Consumer Guarantees

All products and services purchased in Australia come with automatic consumer guarantees under the ACL. These guarantees ensure that goods must:

• Be of acceptable quality (safe, durable, and free from defects)
• Match their description, sample, or demonstration model
• Be fit for any disclosed purpose
• Perform as the seller promised
• Services must also be delivered within a reasonable timeframe or as agreed with the supplier.
  

• When You Can Return Goods

• Consumers can return goods if they fail to meet these guarantees. The type of remedy depends on the severity of the problem:

  • Major problem: The product is unsafe, substantially unfit for its purpose, or very different from its description, and cannot be fixed within a reasonable time. Consumers can choose a refund or replacement. Refunds must be the full amount paid, without deductions for use, and in the same form as the original payment unless agreed otherwise.
• • Minor problem: The business can offer a repair or replacement. If the repair is not effective, the consumer may then request a refund or replacement.
  • How to claim products under our warranty?
  • In order to be entitled to make a claim under this warranty a Customer must:
  • • contact Kawana Chlorinator Spares by email (kcs@kawanachlorinatorspares.com.au) or by phone on +61 7 5493 9039 within a reasonable period after the Failure is apparent (or reasonably apparent);
  • • provide Kawana Chlorinator Spares the following information:
  • 1.  the Customer’s full name, phone number and email address;
    2. the Product serial number (control and cell);
    3. the Product purchase date;
    4. complete details associated with the Customer’s claim; and
    5. written evidence of purchase of the Product.
